{"id":145310,"date":"2023-12-14T07:15:00","date_gmt":"2023-12-14T10:15:00","guid":{"rendered":"https:\/\/folhapopular.info\/?p=145310"},"modified":"2023-12-14T17:56:36","modified_gmt":"2023-12-14T20:56:36","slug":"stf-determina-ao-congresso-regulamentacao-da-licenca-paternidade","status":"publish","type":"post","link":"https:\/\/folhapopular.info\/index.php\/2023\/12\/14\/stf-determina-ao-congresso-regulamentacao-da-licenca-paternidade\/","title":{"rendered":"STF determina ao Congresso regulamenta\u00e7\u00e3o da licen\u00e7a-paternidade"},"content":{"rendered":"\n<p>O Supremo Tribunal Federal (STF) decidiu nesta quinta-feira (14\/12) determinar ao Congresso Nacional a aprova\u00e7\u00e3o de uma lei para garantir a regulamenta\u00e7\u00e3o da licen\u00e7a-paternidade no pa\u00eds.<img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1572462&amp;o=node\"><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1572462&amp;o=node\"><\/p>\n\n\n\n<p>Com a decis\u00e3o, os parlamentares ter\u00e3o prazo de 18 meses para regulamentar as regras do benef\u00edcio.&nbsp;Caso a norma n\u00e3o seja aprovada, a licen\u00e7a-paternidade dever\u00e1 seguir as regras da licen\u00e7a-maternidade, que tem dura\u00e7\u00e3o de 120 dias.<\/p>\n\n\n\n<p>A Corte julgou uma a\u00e7\u00e3o protocolada em 2012 pela Confedera\u00e7\u00e3o Nacional dos Trabalhadores na Sa\u00fade (CNTS) a favor do benef\u00edcio.<\/p>\n\n\n\n<p>Atualmente, a licen\u00e7a-paternidade \u00e9 de cinco dias consecutivos nos casos do nascimento de filho, ado\u00e7\u00e3o ou de guarda compartilhada. O direito est\u00e1 previsto na Consolida\u00e7\u00e3o das Leis do Trabalho (CLT) e foi criado com a promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o de 1988.<\/p>\n\n\n\n<p>Pelo Ato das Disposi\u00e7\u00f5es Constitucionais Transit\u00f3rias (ADCT), regras transit\u00f3rias criadas com a promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o, a licen\u00e7a de cinco dias deveria permanecer at\u00e9 o Congresso aprovar uma lei complementar para implementa\u00e7\u00e3o definitiva, vota\u00e7\u00e3o que nunca ocorreu.<\/p>\n\n\n\n<p>Prevaleceu no julgamento o voto do ministro Lu\u00eds Roberto Barroso para reconhecer a omiss\u00e3o do Congresso em aprovar a regulamenta\u00e7\u00e3o da norma. O entendimento foi seguido pelos demais ministros.<\/p>\n\n\n\n<p>De acordo com a Organiza\u00e7\u00e3o Internacional do Trabalho (OIT), a licen\u00e7a-paternidade existe em 115 pa\u00edses e \u00e9 remunerada em 102. O custeio \u00e9 feito com recursos do empregador, benef\u00edcios de prote\u00e7\u00e3o social dos governos ou dividido entre as duas fontes.
